1. Contract agreement
SUN*Properties Marketing, S. L. organises contracts between the landlord (lessor) and the tenant (lessee). The conclusion of rental agreements through SUN*Properties Marketing, S. L. is executed both by order of and on behalf of the owner or caretaker of the property.
The contract can be finalised in writing, or orally by telephone; it is valid for the period of time indicated and refers only to the number of people stated in the contract. SUN*Properties Marketing, S. L. is only obliged to provide the services agreed in the leasing contract.
The information about the property and the description of the contents has been checked by a member of our company. However, we can not guaranteee that the information is complete and up-to-date.
2. Payment
The leasing contract is validated by paying a deposit to SUN*Properties Marketing, S. L. or to the owner. The deposit must be paid within three working days of receiving confirmation of the booking. The balance of the agreed sum, and the security deposit (if applicable), is to be paid in accordance with the terms stipulated in the contract.
In the event of SUN*Properties Marketing, S. L. or the lessor not receiving the deposit within 8 working days, the client will lose the booking and the property may be let to someone else. In this case, the client will be informed of the cancellation of the booking by e-mail or fax.
3. Cancellation
Cancellation of the contract by the lessee must be confirmed in writing. It is important to state the date of the cancellation as SUN*Properties Marketing, S. L. will levy the cancellation charge according to the scale below. This amount is calculated as a percentage of the
full rental price:
- up to 90 days before the beginning of the rental period: 30%
- up to 30 days before the beginning of the rental period: 60%
- 29 days or less before the beginning of the rental period: 100%
Subject to agreement with SUN*Properties Marketing, S. L. the lessee may transfer the contract to a third party who must accept the same terms and conditions. A €20.00 administration fee will be charged for this service, payable by the original lessee.
4. Lessor’s Liability
It is the lessor’s responsibility to make sure that the property is available at the time and on the date agreed upon. However, the lessor cannot be held liable for circumstances beyond his control e.g. strikes, war, failure of the mains water or electricity supply, or storms.
Should the holiday home be unavailable or can only be used in a limited manner for other reasons, and in the event of the lessor being unable to organise a new property, the lessor is liable for the full amount previously paid by the lessee.
The lessor cannot be held liable for any accidents or personal injuries that may occur either inside or outside the property during the rental period. The client is responsible for any articles of value or cash – the lessor cannot be held liable in the event of burglary.
5. Rental period not fully used
If the lessee does not occupy the property due to late arrival or leaves before the end of the rental period for any reason, independent of the owner, the lessor and / or the broker, the lessee cannot claim a refund.
6. Cooperation request
The lessee is asked to check the house and the contents on arrival. If there is any damage he is requested to inform the lessor or the contact person in Tenerife within 24 hours, so that the damage can be assessed and repaired.
The lessee is expected to take care of the contents of the house and is obliged to report and replace broken articles or repair any damage caused during the stay. The accommodation and the contents are rented in a good condition. The use of the house and pool is entirely at the lessee’s and other occupants’ own risk.
7. Lessor’s right to withdraw from the Contract
The lessor or SUN*Properties Marketing, S. L. acting as the lessor’s representative can cancel the contract without complying with the terms if:
the lessee or an associated occupant damages the house on purpose the lessee or an associated occupant does not follow the house rules or disturbs or endangers others on arrival the lessee does not pay the balance due or the service deposit agreed upon.
In these cases the full rental price is forfeited. If the lessor or SUN*Properties Marketing, S. L. acting as the lessor’s representative, withdraws from the contract before the departure date due to unforeseen circumstances, the money already received will be refunded immediately, any further demands will be explicitly excluded.
8. Arrival and Departure
On arrival the lessee may move into the property between 15.00 and 22.00 at the latest. The lessee must vacate the property by 10.00 a.m. on the day of departure. Any change in the arrival and departure times must be agreed with the lessor.
9. Rented Cars
SUN*Properties Marketing, S. L. can organise car rentals, however, this is a private agreement between the client and the car rental company. Any claims for compensation are to be addressed directly to the car rental company. This agreement is regulated by Spanish law.
Clients are strongly advised to take out comprehensive travel and medical insurance prior to departure.
